The Social Security Disability Process

1. Contact the nearest Houston Regional Social Security Disability Office.

Appointments can be made over the phone or in person. If you would like to complete the Social Security Disability application over the phone the Houston Regional Social Security Disability representative will help you complete the forms.

2. A Houston Social Security Disability representative can review your application and help determine if you will qualify for Supplemental Security Income benefits or the Social Security Disability Insurance program.

In order to qualify for the SSDI program you will have to have earned enough “work credits”. Resources can be defined as bank accounts, vehicles, cash, property, life insurance, land or anything that can be sold for cash. To qualify for Supplemental Security Income benefits your total resources and cash available less all the qualified exemptions must be less then the pre-determined SSI allowable income limit.

3. If the Disability Determination Services Office (DDS) determines that you meet all of the requirements to receive Social Security Disability payments they will determine the amount of money you will receive each month.

What Happens if Your Houston Social Security Disability Insurance or Supplemental Security Income is Approved?

If you are approved for either Supplemental Security Income benefits or the Social Security Disability Insurance program you will receive written notification of the amount of monthly payment you will receive and the date the first payment will arrive. The amount you will receive will be determined based on a pre-determined payment formula.

The Social Security Disability Insurance payments will consider the amount of taxes you paid, your average wage, your age, and time in the workforce. The wage value will be an average of the wages you made over the total years you worked and not necessarily your highest salary.

Supplemental Security Income benefit amount will add your resources plus cash, less allowable exemptions, and subtract this amount from the total allowable Supplemental Security Income payment amount. To derive the total allowable Supplemental Security Income payment amount your family status will be considered.

You will be able to receive Social Security Disability payments as long as you are disabled. Periodic review will be done to determine if you are receiving the appropriate Social Security Disability payments and if you are still disabled. It is important to maintain all of your health and financial records.

Houston Social Security Disability Insurance or Social Security Income Benefits Denied

If you are denied Social Security Disability benefits in the Houston region you can appeal the decision. The first step is the “reconsideration” process. It is important to contact a Texas Social Security Disability attorney if your Social Security Disability application is denied.

The Houston regional offices listed below will evaluate applications for the reconsideration processes, hearings and Appeal council reviews. Steps to Appeal denial in the Houston, Texas region:

1. If your application is denied you will have 60 days to file a “reconsideration” with the appropriate Disability Adjudication and Review office in your area. A Houston Social Security Disability Lawyer is an expert in the reconsideration process and all subsequent appeals processes.

2. After the reconsideration process if you still receive a denial you can have your case reviewed in front of an Administrative Law Judge.

3. If your application is still denied by the Administrative Law Judge you can request a disability hearing in front of the Appeals Council.

4. If the Appeals Council still denies your Social Security Disability application you and your Social Security Disability Attorney can file a case in Federal Court.
